How a contract is formed

Showing a volume on this site is an invitation to make an offer, not a binding offer. You make a binding offer when you complete payment on the Stripe checkout page. The contract is concluded when we accept it by making your download available. The contract language is English. We do not file the contract text separately, but these terms stay available on this page and your receipt comes from Stripe.

Prices

A volume costs 9.99 euro. All prices include German VAT. There are no delivery costs, because nothing is shipped.

What you receive

Each volume is a single ZIP file containing the desktop wallpapers listed for that volume on the shop page, at full resolution. Delivery is by download link, shown after payment and sent to the email address you gave Stripe. The link stays valid for 30 days. If it expires before you have your files, write to us and we will issue a new one.

Licence

You may use the wallpapers on your own devices, as many as you personally own, for as long as you like. You may not resell them, give them away, publish them, include them in another product, or use them commercially. Copyright stays with Flox.

Right of withdrawal

As a consumer you normally have fourteen days to withdraw from a distance contract without giving a reason. The period runs from the day the contract is concluded. To withdraw, tell us clearly that you wish to do so, by email to info@finnfreeman.com or by post to the address above. You may use the model form below, but you do not have to.

When the right expires early

Because a volume is digital content delivered immediately, the right of withdrawal ends as soon as we start delivering it, provided you have asked for that and acknowledged the consequence. That is exactly what the checkbox at checkout does. Its wording is:

“I expressly request that Flox delivers the digital content immediately, and I acknowledge that I lose my right of withdrawal once the download is made available.”

This follows § 356 (5) BGB. If you would rather keep your withdrawal right, do not tick the box, and instead write to us and we will arrange the purchase differently.

Model withdrawal form

To Finn Freeman, Regerstrasse 27, 81541 Munich, Germany, info@finnfreeman.com:

I hereby give notice that I withdraw from my contract for the purchase of the following goods: ... Ordered on: ... Name of consumer: ... Address of consumer: ... Signature of consumer (only if this form is notified on paper): ... Date: ...

If something is wrong with the files

Your statutory rights in respect of defects apply. If a file is corrupt, will not open, or is not what the volume described, tell us and we will repair it, replace it, or refund you.

Liability

We are liable without limit for damage caused intentionally or through gross negligence, and for injury to life, body or health. For slight negligence we are liable only where we breach an obligation that is essential to performing this contract, and then only for foreseeable damage typical of this kind of contract. Liability under the German Product Liability Act is unaffected.

Governing law

German law applies, without the UN Convention on Contracts for the International Sale of Goods. If you are a consumer living in the EU, this does not remove the protection of mandatory rules in your own country.

Dispute resolution

We are not obliged to take part in dispute resolution proceedings before a consumer arbitration board, and we do not do so voluntarily.
